These terms (“Terms”) govern your use of the Chicago’s Best Rentals website at chicagosbestrentals.com and chicagosbestrentals.app and the apartment-locating services we offer through it (together, the “Services”). By using the Services, you agree to these Terms and to our privacy policy. If you do not agree, please do not use the Services.
Who we are
Chicago’s Best Rentals is a licensed Illinois real-estate apartment-locating service affiliated with Baird & Warner, a licensed Illinois real-estate brokerage. We help renters find apartments, surface current offers, and arrange tours. Property owners and managers compensate us when a renter we introduce signs a lease; that compensation comes from the property, not from you.
Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the Services. By using the Services, you represent that you meet these requirements.
What the Services are — and are not
We provide information and locating assistance to help you find an apartment. Using the website or submitting a form does not, by itself, create an agency, brokerage, or representation relationship, a lease, or any obligation on your part or ours; any such relationship is formed only if separately agreed. We do not own, operate, or control the buildings shown, and we are not a party to any lease or application between you and a property.
No guarantee; availability and pricing
Apartment availability, pricing, floor plans, amenities, offers, and other details are gathered from property owners, managers, and other third-party sources on a best-effort basis and can change or become unavailable at any time without notice. We do not guarantee that any apartment, price, or offer will be available, or that we will find an apartment for you. Always verify details directly with the property before relying on them or signing anything.
Your responsibilities
- Provide accurate, current information, and only submit information you have the right to share.
- Use the Services only for your own genuine apartment search and for lawful purposes.
- Do not misuse the Services, submit false or automated inquiries, or attempt to disrupt or gain unauthorized access to the website.
Communications consent
By providing your contact information, you agree that Chicago’s Best Rentals and its licensed agents may contact you by phone call, text message (SMS), and email about your apartment search, as described in our privacy policy. You can opt out of texts by replying STOP or ask us to stop contacting you by emailing gui@chicagosbestrentals.com.
Third-party properties, links, and services
The Services reference apartments and may link to third-party websites and leasing systems that we do not control. Your dealings with any property — including tours, applications, fees, and leases — are between you and that property and are subject to its own terms.
Intellectual property
The Services, including the software, design, text, and other content, belong to Chicago’s Best Rentals or its licensors. You may use the Services for your personal apartment search but may not copy, scrape, distribute, or create derivative works from them without our permission.
Disclaimer of warranties
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty as to the accuracy or completeness of apartment information.
Limitation of liability
To the fullest extent permitted by law, Chicago’s Best Rentals and its agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost opportunities, arising out of or relating to your use of the Services or any apartment, offer, or property you learn about through them.
Indemnification
You agree to indemnify and hold harmless Chicago’s Best Rentals, Baird & Warner, and their agents from claims and expenses arising out of your misuse of the Services or your violation of these Terms or of applicable law.
Fair housing and licensing
Chicago’s Best Rentals is committed to equal housing opportunity and complies with the Fair Housing Act and Illinois real-estate law. Real-estate services are provided by licensed Illinois real-estate professionals affiliated with Baird & Warner.
Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Services will be brought in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction. We encourage you to contact us first at gui@chicagosbestrentals.com so we can try to resolve any concern informally.
Changes and termination
We may update these Terms from time to time; material changes will be reflected by the “last updated” date above, and your continued use of the Services means you accept the updated Terms. We may suspend or discontinue the Services, or restrict access, at any time.
